4. License and Access Rights
Grant of License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Platform solely for your internal business purposes.
Access Control: Access to certain features may be restricted based on your user role (e.g., client vs. DataLab admin). The Platform uses role-based access controls (including Row-Level Security via Supabase) to safeguard data integrity and privacy.
5. Acceptable Use and User Responsibilities
You agree to use DataLab in accordance with all applicable laws and refrain from:
- Misusing the Platform, such as attempting unauthorized access to restricted areas or systems.
- Uploading or transmitting any data that infringes upon the rights of any third party.
- Using automated means to access or interact with the Platform without our express permission.
- Engaging in any activity that could harm the performance, security, or integrity of the Platform.
6. Data and Content
Client Data: The data you input (e.g., ad spend, sales numbers, web traffic, and calculated metrics) remains your property. We process, store, and safeguard such data using industry-standard practices and Supabase’s Row-Level Security policies.
Content Ownership: Any content provided by DataLab, including dashboards, reports, insights, and recommendations, remains the intellectual property of The Data Lab unless otherwise explicitly agreed upon.
Data Accuracy: While we strive for accuracy, DataLab’s insights and reports are provided “as is” and should be validated by you. We do not warrant the absolute accuracy or reliability of the data output.
7. Intellectual Property
Our IP: All content, software, designs, interfaces, graphics, text, and other materials related to the Platform are protected by copyright, trademark, and other intellectual property laws.
User Feedback: Any feedback or suggestions you provide regarding the Platform may be used by us without compensation or obligation.
8. Fees, Payments, and Subscriptions
Payment Terms: Access to DataLab may be subject to subscription fees or other charges as described on our pricing page. Payments are due in accordance with the terms outlined at purchase.
Modifications: We reserve the right to change our fees and billing methods upon providing appropriate notice to users.

9. Termination
Termination by You: You may terminate your account at any time by following the procedures provided within the Platform.
Termination by Us: We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms or if we believe that your use of the Platform could be harmful to other users or our services.
Effect of Termination: Upon termination, your license to use DataLab terminates, and you must cease all use of the Platform. We may retain your data for a reasonable period, subject to our data retention policies and any legal obligations.
10. Disclaimers and Limitation of Liability
Disclaimer of Warranties: DataLab is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied (including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement). We do not warrant that the Platform will meet your requirements or that its operation will be uninterrupted, timely, or error-free.
Limitation of Liability: To the fullest extent permitted by law, The Data Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits or data) arising out of or related to your use of DataLab. Our total cumulative liability shall not exceed the amounts you have paid to us in the 12 months preceding the claim.
Third-Party Links and Services: DataLab may contain links to third-party websites or services which are provided solely for your convenience. We do not endorse or assume any responsibility for any third-party content, products, or services.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Data Lab and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:
- Your access to or use of DataLab.
- Your violation of these Terms.
- Your infringement of any intellectual property or other rights of any party.
